Terms of Service
These terms are Ceroc & Modern Jive Dance Company P/L’s (ABN 63 087 038 668) (C&MJ) terms of service (Terms). They apply to any events or services provided by C&MJ (C&MJ Actvities), and you accept and agree to these Terms when participating in any C&MJ Activities.
1. Additional terms may be posted by C&MJ at venues where C&MJ Activities are provided (Venue Rules). Venue Rules are in addition to these Terms, and you agree to abide by any Venue Rules in addition to these Terms at those venues. If there is any inconsistency between these Terms and the Venue Rules, these Terms prevail to the extent of the inconsistency.
2. You must follow directions or instructions given to you by any of C&MJ’s officers, employees or person authorised by C&MJ (C&MJ Personnel) during the course of your participation in any
C&MJ Activities and agree any C&MJ Personnel may refuse to permit your participation in any C&MJ Activities or admission to any premises where C&MJ Activities are provided.
3. You are responsible for any personal property you bring to any venue. C&MJ and C&MJ Personnel do not accept any responsibility for, and are not liable for, any damage, loss or theft of your
personal property at any venue.
4. RISK WARNING: You acknowledge and agree:
a. this section 4 constitutes a “risk warning” in accordance with the Civil Liability Act 2002 (NSW);
b. you have been made aware that participating in any C&MJ Activities can involve strenuous physical activity and that certain risks or dangers may occur, whether from your actions, the actions of others or the state of venues, and could include physical injury (such as muscle and ligament strains or tears, sprains, back injuries, concussion or broken bones). In very rare cases an injury can be life threatening or result in permanent disability. If you have a pre-existing injury, participating in C&MJ Activities could exacerbate that injury;
c. you participate in any C&MJ Activities voluntarily, at your own risk, and must make your own judgement as to your ability to participate;
d. any C&MJ Activities you undertake are for the purposes of recreation, enjoyment or leisure; may be undertaken with one or more other persons as part of a group, and C&MJ and any C&MJ Personnel are not liable for the actions of other participants.
5. To the extent permitted by law, C&MJ and C&MJ Personnel do not accept liability for any personal injury sustained by you as a result of participating in any C&MJ Activities or abending
any venue where C&MJ Activities are provided, even if they were caused by the negligence of C&MJ or any C&MJ Personnel.
6. C&MJ has the exclusive right to the name “CEROC & MODERN JIVE” and has exclusive rights to the CEROC & MODERN JIVE LOGO (C&MJ Marks) and you must not use any part of C&MJ Marks or any variants in the course of any trade or in any publication without the written consent of C&MJ.
7. For six months after you last participate in any C&MJ Activities (Last Activity), you cannot teach, share, or publish dance steps you became aware of from C&MJ Activities, within 15km of any
venue where C&MJ Activities were held in the 12 months before your Last Activity.
8. You may not, without C&MJ’s consent, promote, in any way, any other dance style or dance event at or within the immediate vicinity of any venue at which C&MJ Activities are conducted, and
C&MJ may remove any promotional material you bring to or place within or near such venues.
9. Personal information collected by C&MJ will be used for marketing purposes and communication via e-mail, SMS or other electronic forms and you consent to be contacted in this way. Your
personal information will not be sold or given to any third party. For full details of how C&MJ handles your personal information please see C&MJ’s Privacy Policy.
10. If any part of these Terms, any Venue Rules or their application to any person, is found by a Court to be invalid that will not affect the remainder of the Terms or applicable Venue Rules which will remain in full force.
11. To the extent permitted by law, with respect to any C&MJ Activities, C&MJ limits its liability to supplying the services again or paying for them to be supplied again and will not in any way be
liable for any consequential or indirect losses.
12. Unless you otherwise inform C&MJ, you warrant you are 18 years or older when participating in any C&MJ Activities. Persons under 18 (Minors) must be accompanied by a parent or guardian
(Responsible Person) if participating in any C&MJ Activities, unless prior agreement is obtained from C&MJ.
13. The Responsible Person is responsible for the welfare and care of the Minor and C&MJ encourages a Minor’s participation in any C&MJ Activities to be limited to participation with their
Responsible Person or family members.
14. C&MJ reserves the right to change these Terms at any time and your continued participation in any C&MJ Activities will constitute acceptance of any changed Terms.
